Terms and Conditions of Sale

This section tells you about the terms and conditions on which we supply any of the product (Products) listed on our website www.frankscarpets.com (our site).

Please read these terms and conditions carefully before ordering any Products from our site. When placing an order, you will be invited to agree to these terms and conditions by ticking the box marked "I agree to the terms and conditions". If you don’t accept the terms and conditions by ticking this box, you will not be able to order any Products from our site.

Information About Us

www.frankscarpets.com is a site operated by Franks carpets limited (we, our, us). Franks carpets limited is registered in Ireland under company number 221341 and VAT registration number 8221341F. Our trading address is at Unit A North Link Retail Park, Coes Road, Dundalk, County Louth, Ireland.

Service Availability

Our site is intended for use by people resident in Ireland & Northern Ireland. We do not accept orders where delivery is required to locations outside Ireland and Northern Ireland. However if you are outside this area and would like to purchase a product from us feel free to contact us at our store by phone.

Your status

By placing an order through our site you warrant that:

You are legally capable to enter into binding contracts;

You are at least 18 years old;

You are resident in and require delivery to Ireland or Northern Ireland.

Returns Policy

At Franks Carpets Limited we want you to be happy every time you shop with us. If you are not satisfied with your purchase or have changed your mind, we will offer you a full refund if you decide it's not what you're looking for. This must be done within 7 days on receiving your item(s) and is subject to our terms and conditions. Certain items are excluded from our returns policy. These include items of flooring that have been specifically cut to size, custom ordered items and items that have been specially ordered in. If you are unsure of whether the item(s) purchased are included in our 7 day return policy, please contact us before order.

To return your items, please send them to Franks Carpets limited, Unit A, North Link Retail Park, Coes Road, Dundalk, Co. Louth, Ireland. Please enclose a copy of the delivery note with the goods. You will be responsible for any postage charges. All returned (non-faulty) goods must be in their original unopened packaging and in a condition that would enable us to sell the item to someone else as new.

Please note that we cannot refund delivery costs we have already charged you. You will be responsible for all costs associated with returning the goods to us unless the goods are faulty. For your peace of mind and protection, when you return goods

to us we suggest that you take out appropriate insurance.

Cancellation Policy

If you are contracting as a consumer, you may cancel a Contract at any time within 7 working days, subject to our term and conditions, beginning on the day after you received the Products. Provided you comply with this clause and the Returns Policy, and take reasonable care of the Products, you will receive a full refund of the price paid for the Products in accordance with our returns policy.

Members of the European Union have a 7 day "cooling off period" in which time they may cancel their order. You have the right to cancel your order with Franks Carpets Limited and to return your complete order within 7 working days of receipt for any reason. Goods must be returned at your expense, unopened and in their original condition. It is your responsibility to ensure the safe return of the goods and we therefore recommend that you obtain appropriate insurance to cover the cost of the goods. Once we have received the goods, we will refund all monies paid, providing the goods have not been damaged, opened or altered in any way. Certain items are excluded from our returns & cancellation policy. Under European Union law goods made to a personalised specification are not subject to the 7 day “cooling off period".

These include items of flooring that have been specifically cut to size, custom ordered items and items that have had additional features added. Unfortunately we can not accept cancellations or returns sales on special non stock products. If you are unsure of whether the item(s) purchased are included in our 7 day return policy, please contact us before order. We do not accept the return of part orders. Refunds will be processed within 30 days of us receiving the returned goods, unopened and in their original condition.

To cancel a contract for goods that fall inside the 7 day cooling off period, you must inform us in writing within 7 days from you receiving the goods, Please write to us at Unit A, North Link retail park, Coes Road, Dundalk, County Louth, Ireland , or by e-mail to info@frankscarpets.com. Please note that we can only refund delivery costs if the return is a result of our error. This must be arranged beforehand contacting us.

This does not affect your statutory rights as a consumer.

Ordering Products

After placing an order, you will receive an email from us acknowledging that we have safely received it. This does not mean that your order has been accepted. All orders are subject to acceptance by us, and we will send you an email to confirm acceptance. The contract between us (Contract) will only be made when we send you the email confirming acceptance of your order and we have taken payment.

Availability

All items are subject to stock availability. We will inform you as soon as possible if, for any reason, the Products you have ordered are not available. Please note that, on rare occasions, stock may become unavailable after we have accepted your order. In such circumstances, we may need to cancel the Contract with you. In such circumstances, if we have taken payment from your credit card or debit card we will refund the amount paid by you in full and we will not have any other liability towards you.

Ordering Errors

You are able to make changes to your order up to the point at which you click on the ‘submit order’ button on the Payment & Confirm section of the checkout process.

Prices

The price of the Products will be as quoted on our site, except in cases of obvious error. Please be aware that these prices include VAT. Prices do not include delivery charges. Due to the large number of Products on our site, it is always possible that some of the Products listed on our site may be incorrectly priced, despite our best efforts. We will normally verify prices as part of our order-handling procedure so that, where a Product's correct price is less than our stated price, we will charge the lower amount when dispatching the Product to you. If the Product’s correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before dispatching the Product, or reject your order and notify you of the rejection. We are under no obligation to provide the Product to you at the incorrect (lower) price, even after we have sent you an order acceptance, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing.

Payment

We accept all major debit and credit cards. Presently, we do not accept cash, cheques or gift vouchers as payment online or payment through PayPal. By submitting an order to us through our site, you are confirming that the payment details provided on your order are valid and correct. We will process your credit or debit card details immediately after you place your order.

Please note that delivery of the Products to you is conditional upon payment first having been made in full.

Delivery

We can deliver anywhere in Ireland or Northern Ireland however due to the vast combinations of sizes and weights of the products we sell, and also the distances involved, we are unable to offer a standard delivery charge across all of Ireland. Delivery costs have been provided where possible and we are happy to give you a quote for counties outside the priced delivery area.

We can however deliver carpet and flooring throughout Ireland to any business address for €50 per carpet roll or pallet. If this is an option for you please contact us before placing your order and we can inform you of the details.

For counties outside the areas listed under our delivery charges section please contact us prior to ordering and we will be able to give you a quote. You can place the order and arrange collection or delivery afterwards if you wish.

Please bear in mind that some of the products that are sold, on this site, are not stock items with Franks Carpets Limited. In general most items that we do not stock will be with us within 10 to 12 working days from order, unless otherwise stated on our web site. From time to time products may be out of stock with the manufacturer. If this is the case we will contact you immediately to inform you of the time frame for expected dispatch.

If your item is not in stock, we will notify you immediately and backorder the item for you. You will have the option to cancel your order if you would rather not wait when we inform you of a delay.

Once we have received your order we will contact you within 3 working days and advise on an expected dispatch date.

We can only deliver carpets and flooring to ground floors and must be informed of any parking restrictions and access problems when a representative contacts you on confirmation of the order.

We will contact you on the day before delivery to confirm the delivery and also that you will be there to sign for the delivery. Whilst every care is taken when delivering, if you ask us to bring products into your home we take no responsibility for any damage that may occur. This includes but is not limited to marking door frames, floors and walls. It is advisable that you protect your floor and carpeting with suitable coverings.

Please also inspect your goods immediately on delivery before signing the delivery note. No claims with regard to damage/incorrect items will be accepted after the courier has left the delivery address unless signed for as damaged/incorrect items on the delivery note.

We aim to deliver all orders within 7 working days of your product(s) being at our store. However, if you are located in a remote area, delivery may take a little longer.

Although we will make every reasonable effort to ensure your products are delivered within the timescales given above, unfortunately we cannot guarantee that they will not be affected by unforeseen issues affecting our delivery partners. Under these circumstances, delivery charges will not normally be refunded. Either we or our contractors will contact you to arrange for delivery of the Products and will give you a delivery time slot. If delivery is attempted during that time slot and you are not available to take delivery, we reserve the right to charge you for any loss that we may suffer as a result.

Risk and Title

The Products will be at your risk from the time of delivery even if you have given us notice that you wish to cancel the Contract. Ownership of the Products will only pass to you at the time of delivery once full payment has been received including delivery charges.

Your Information

We process information about you in accordance with our privacy policy. By using our site, you consent to such processing.

Our Liability

In the event of a fault in our Products (including a defect or a Product not matching its description) notified to us within a reasonable time after delivery, we will contact the manufacturer and arrange the manufacturer to call and inspect the product. If it is confirmed that there is a fault and provided that the Products have been treated by you in accordance with the manufacturers’ guidelines and care instructions, we will either exchange the products, offer a discount or refund you in full for the product purchased, after the faulty product has been collected, but we shall not have any other liability towards you.

Once opened please check your material carefully before installation. In the unlikely event that your goods are faulty on arrival please let us know within 7 days of delivery. Some faults may have to be inspected on site if they have occurred after installation so we may need to have the flooring inspected by the manufacturer at your premises to solve the complaint. We therefore reserve the right to have the carpet inspected by a manufacturer's representative before work can be carried out. Carpets must be installed in compliance with British Standards B.S.5325.

All flooring products should be fitted by a qualified fitter. All carpet and vinyl products that we sell should be fitted in accordance with British Standard BS 5325 (textiles / carpets) and British Standard BS 5808 (Underlays). All timber products should be fitted in accordance to British Standard BS BS 8201:1987

This does not affect your statutory rights

Events outside Our Control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control including Acts of God, fire, flood, severe weather, explosion, war, act of terrorism, industrial dispute (whether or not involving Franks carpets limited’s employees), failure or delay on the part of a sub-contractor or supplier or acts of local or central Government or other competent authorities. This does not affect your statutory rights.

Severability

If any of these terms and conditions is held to be invalid, the remaining terms and conditions shall continue to be valid to the fullest extent permitted by law.

Entire Agreement

These terms and conditions and other notices elsewhere on our website contain the whole agreement between us and you relating to the supply of Products. No other terms or conditions will form part of the Contract, unless agreed by us in writing and signed by an authorised Frank’s carpets limited employee.

Product characteristics

Franks carpets ltd assume that you the customer are fully aware before ordering, of the different inherent characteristics, as detailed below, of the products that we sell on our web site.

Carpet Shading

Carpet is a soft, luxurious product and flattening of the pile will occur as a natural result of use. The sides of the pile appear a slightly different shade in color to the ends and so any flattening will change the apparent color of the carpet and this can be patchy when the use of the carpet varies in different areas. Deep pile carpets, such as Saxony’s or velvets, for example will probably show your footprints and this is a shading effect. This is not a manufacturing defect and will not affect the wear life of your carpet. Such shading and flattening is not a fault. Shading is a natural phenomenon which cannot be totally eliminated in the production process and is therefore not considered to be a manufacturing fault. Areas where foot traffic twists and turns (for example near stairs or in front of seating) can be especially prone to such changes in appearance. The shading effect can be exaggerated by such things as room lighting and certain types of traffic across the carpet.

The use of castor cups under heavy furniture will spread the weight over a larger area and minimise dents in the carpets surface.

Berber Yarns

Natural yarns are random blended. That is to say that undyed natural wool is mixed with dyed wool, to give Berber and tweed carpets their flecked look. Because of this there may be a lined effect not seen in a small sample. This is a natural characteristic of berbers and not a manufacturing fault.

Visible Bands

When carpets are stored in warehouse racks, they are subject to considerable and sustained pressure. As a result, crush lines may be visible when the carpet is first unrolled and may be more noticeable in lighter, open ground shades. Often at the end of the carpet were it touchs the cardboard pole in which it is wraped, the pile may be crushed for approximately 12 inchs and can appear as a band accross the carpet. These bands will disppear as the carpet settles into its new environment and as the pile is flexed through normal use and vacuum cleaning.

Fading

Although every care is taken to ensure dyes meet strict requirements, carpets, as with other natural textiles, cannot be dyed absolutely fast to light. Carpets will tend to fade when subjected to sunlight. Normal wear and light soiling will also give the appearance of fading and both effects are obviously beyond the control of the manufacturer.

Color

The colors of carpets and flooring shown on this site are as accurate as possible. However, colors may well appear slightly different on different PC monitors as settings may not be the same and different again under the lighting conditions in your home. Please order samples to confirm colors and inspect the carpet in the lighting of your own home.

Dye batches also vary and therefore it may be possible that your carpet does vary very slightly from the sample. It is however very rare that this difference is significant enough to cause a problem.

Sprouting Tufts

To give cut pile carpets their smooth level, surface; they are put through a shearing process. This action can be likened to that of mowing a lawn. Each roll is made up of millions of tufts and there is likelihood that some of them may have been missed during shearing. After a time, these work their way to the surface and appear as sprouting or shooting yarn. Pets with claws may also snag or pull the tufts causing the same effect. NEVER pull a tuft, simply cut it off level with a sharp pair of scissors.

Shedding

All newly fitted carpets will tend to shed, or fluff, which is perfectly normal and will diminish naturally in a few weeks. The only efficient way to remove this is by vacuuming. If this is not done, the fluff remains on your carpet and will be trodden back into the pile resulting in a flat, matted and dull look.

Size Tolerance

All sizes quoted are approximate. Slight variations are unavoidable and a tolerance of plus or minus ½" (1.25cm) is allowable in accordance with clause 3 of British Standard 3655 of 1981.

Timber Flooring

Please note that hardwood flooring is a natural product. Franks Carpets Ltd will endeavour to supply the Goods to the specified size and colour but shall not be responsible for minor variations in size, colour, texture and general wood quality. Timber being a natural product, variations in colour, texture, grain and machining tolerances are to be expected. We expect all timber floors to be fitted to British standard BS 8201:1987 - Code of practice for flooring of timber, timber products and wood based panel products.
